Fireworks Act | Highspire Borough Police Service

Highspire Police wishes everyone a Happy 4th of July! Be aware of the laws in place for the use of fireworks in the Borough of Highspire. Attached is the Highspire Ordinance in effect since the Fireworks Act 2018.

Article 2404. Use of consumer devices. (a) Conditions.–A person 18 years of age or older who meets the requirements of this section may purchase, possess and use consumer devices.

(b) Prohibitions.–A person may not intentionally light or discharge:

(1) Consumer fireworks on public or private property without the express permission of the owner.

(2) Fireworks or sparkling consumer devices inside a motor vehicle or building, or the launching of fireworks or sparkling consumer devices.

(3) Consumer fireworks or sparking devices in or on a motor vehicle or building or on another person.

(4) Fireworks or sparkling devices for consumption while the person is under the influence of alcohol, a controlled substance or another drug.

(5) General public fireworks within 150 feet of an occupied structure.
